In this trade secrets case, Plaintiff Lifeway Foods, Inc. previously obtained a protective order preventing Defendants from issuing subpoenas to four Lifeway customers that sell Lifeway’s alleged “trade secret” kefir formula under their own labels. Defendants sought to establish that Life- way’s purported trade secrets were shared with third parties and not kept secret by them.

Plaintiff, Lifeway Foods, Inc. (“Lifeway”) moves under Federal Rule of Civil Procedure 15(a)(2) to dismiss Count I of its Complaint, which asserts a claim under the Defend Trade Secrets Act, 18 U.S.C. § 1836 et seq. Lifeway also withdraws its motion for entry of a preliminary injunction (ECF No. 4), which is currently scheduled for a hearing on May 29, 2024. (ECF No. 16.)
